By accessing our website, creating an account, or purchasing any product or service from Mind Right Fit (“MRF,” “we,” “us,” “our”), you agree to these Terms and our Privacy Policy. If you disagree, do not use the site or services.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase. Minors may participate only with parent/guardian consent and supervision for any training.
3. Accounts & Security
You’re responsible for safeguarding your login and for all activity under your account. Notify us immediately of unauthorized use. We may suspend or terminate accounts for suspected misuse.
4. Intellectual Property & License
All site content (text, graphics, logos, videos, programs, downloads) is owned by Mind Right Fit and protected by copyright and trademark laws. With purchase, you receive a limited, non-exclusive, non-transferable license for personal, non-commercial use. You may not copy, share, resell, or distribute content without written permission.
5. Products, Services & Program Access
Digital Content: Instant-access items (e.g., programs, plans, audio/video, e-books, courses) are delivered electronically. Access windows or downloads may be time-limited; keep your files backed up.
Coaching/Training Packages: Session lengths, delivery method (in-person/virtual), and inclusions are stated at checkout. Session logs (Accountability Journal, Fitness Training Log, Diet Log) are provided for your personal use and habit tracking.
Class Packs / Expirations: Unless stated otherwise, class packs and sessions expire 6 months from purchase.
Scheduling & Cancellations: Please give 24 hours’ notice to cancel/reschedule a session or the session may be forfeited. No-shows are treated as used sessions.
Health Clearance: You affirm you’re physically able to exercise. Consult your physician before beginning any program. You agree to stop any activity if you experience pain, dizziness, or shortness of breath and to seek medical attention as needed.
6. Fees, Payments, Taxes & Pricing Changes
Prices are shown at checkout and are subject to change.
We accept major payment methods via secure processors (e.g., Stripe/PayPal).
You authorize us to charge your selected payment method for all purchases, subscriptions, renewals, taxes (including Virginia sales tax where applicable), shipping, and fees.
Chargebacks: Initiating a chargeback without first contacting us to resolve the issue may result in account suspension and referral to collections.
7. Subscriptions & Auto-Renewals (If Offered)
Subscriptions bill automatically at the interval shown at checkout until canceled.
Cancel anytime from your account before the next billing date to avoid future charges.
Partial billing periods are not refunded, unless required by law.
8. Shipping, Delivery & Risk of Loss (Physical Products)
We ship to the address you provide. Title and risk of loss transfer upon delivery by the carrier.
Delivery Estimates: Provided for convenience and are not guarantees.
Damaged/Incorrect Items: Notify us within 7 days of delivery with photos; we’ll replace or issue store credit if verified.
9. Returns & Refunds
Digital Products: Due to instant access, all sales are final and non-refundable.
Coaching/Training: Refunds for unused sessions only if requested within 48 hours of purchase, minus a 10% administrative fee. Scheduled sessions within the next 24 hours are not refundable.
Physical Products: Unused items in original packaging may be returned within 14 days of delivery (customer pays return shipping) unless the item was defective or incorrect. Once received and inspected, we’ll issue a refund to the original payment method (less shipping) or store credit as disclosed at checkout.
Exclusions: Clearance items, gift cards, downloads, and custom orders are final sale.
10. User Conduct
You agree not to: (a) break the law; (b) share or resell login access; (c) infringe IP; (d) transmit harmful, defamatory, or harassing content; (e) interfere with site security; or (f) mine data or scrape without permission.
11. Health, Coaching & Results Disclaimers
Coaching is not therapy or medical care. We do not diagnose or treat medical or psychological conditions. Results vary based on many factors including effort, genetics, and adherence. See full Disclaimer below.
12. Testimonials & User Content
By posting a review, comment, image, or testimonial, you grant MRF a worldwide, royalty-free, perpetual license to use, reproduce, and display that content for marketing and operational purposes, consistent with our Privacy Policy.
13. Third-Party Services
We use third-party providers (e.g., payment, email, analytics). We’re not responsible for third-party sites or policies. See Privacy Policy for data sharing.
14. Disclaimer of Warranties
Services and products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the fullest extent permitted by law, Mind Right Fit, its owners, trainers, and employees shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for any claim will not exceed the amount you paid to MRF for the product/service giving rise to the claim.
16. Indemnification
You agree to indemnify and hold MRF harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the site/services, your breach of these Terms, or your violation of law or third-party rights.
17. Force Majeure
We’re not liable for delays or failures caused by events beyond our reasonable control (e.g., acts of God, labor disputes, supply chain issues, outages).
18. Governing Law, Venue & Dispute Resolution
Governing Law: Commonwealth of Virginia law, without regard to conflict of law principles.
Venue: Courts of Fairfax County, Virginia (state or federal, as applicable).
Informal Resolution: Contact us first to try to resolve disputes in good faith within 30 days.
Arbitration & Class Waiver (Optional—keep only if you intend to implement): Except for small-claims matters, disputes will be resolved by binding arbitration in Fairfax County, VA under the rules of the American Arbitration Association. You waive the right to a jury trial and to participate in a class action.
19. Changes to Terms
We may update Terms at any time. Material changes will be posted with a new “Effective Date.” Continued use constitutes acceptance.
